1. Scope and provider

bidless.ch is operated by Goldboerse.ch AG, Schifflände 3, 4051 Basel, Switzerland (hereafter “we”). These terms apply to all contracts concluded between us and you through bidless.ch. Differing terms of the customer apply only if we agree to them in writing.

2. The falling-price auction

On bidless.ch the price falls instead of rising. Every piece starts at a start price and drops in fixed steps down to a floor price. The start price and the floor price are shown on the auction page from the beginning. There is no bidding and no knockdown: whoever buys first receives the piece at the price shown at that moment.

A running time consists of cycles. If a piece does not sell within a cycle, the price starts again at the start price in the next cycle. How many cycles run is decided by the consignor when booking.

What always applies is the price calculated on our servers. If a display in the browser differs from it — because the device clock is wrong or the connection was interrupted — the server value applies.

3. Formation of contract

The presentation of a piece on bidless.ch is not yet a legally binding offer but an invitation to you to make an offer. By completing the purchase you make a binding offer. The contract comes about as soon as we confirm it or dispatch the goods.

Every piece is unique and available only once. If two people buy at the same moment, the time at which the purchase reaches us decides. If a purchase does not come about for this reason, we inform you without delay; a payment already charged is refunded in full.

4. Prices and VAT

All prices are in Swiss francs and are gross prices: Swiss VAT at the standard rate of 8.1% is included and is shown on the receipt and the confirmation. For deliveries abroad, customs duties, import taxes and fees may arise, which you bear.

5. Payment

The payment methods offered during the purchase are exhaustive. Payment is handled by a specialised payment service provider; card details are processed there and are not stored by us.

6. Retention of title

The goods remain our property until payment in full.

7. Delivery

We ship worldwide, insured and discreetly packed. Delivery times are indicative. Risk passes to you on handover to the carrier, unless mandatory law provides otherwise.

Check the consignment on receipt. Please report transport damage, incomplete deliveries and packaging defects on the day of delivery.

8. Return

Registered customers may return a piece within 14 days of receipt. The goods must come back complete, undamaged and in the condition received, together with accessories and documents. You bear the cost of return unless there is a defect. After receipt and inspection we refund the purchase price.

Excluded from return are pieces made, altered or engraved at your request.

9. Condition and warranty

In most cases these are second-hand goods. They may show signs of use. We describe the condition on the auction page as precisely as we can.

If a piece has been refreshed by our specialists or put through a quality check, and this is noted with the goods, a warranty of three months from receipt applies. It covers neither further wear nor damage caused by yourself.

Otherwise the statutory provisions on warranty apply.

10. Complaints

Please report defects promptly after receipt to info@bidless.ch. We may request evidence before a return, a photograph for instance.

11. Account

You need an account in order to buy. Keep your credentials safe and do not pass them on. Keep the details in your account up to date. In the event of misuse we may block an account.

12. Data protection

How we handle your data is described in the privacy policy.

13. Changes

We may change these terms. For a purchase, the version published on this page at the time of purchase applies.

14. Applicable law and place of jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Basel, unless mandatory provisions prescribe another.
